The licensing information in this section supersedes any previous understandings or agreements, written or oral.

Common definitions:

Live System: computer running a licensed copy of SoftTouch with the intent of commercial traffic.

Test System: computer running a copy of SoftTouch for evaluation purposes or for testing system modifications. No live commercial traffic is permitted on a "test system". In most cases, a "test system" is limited to a maximum of 23 channels (digital systems) or 4 channels (analog systems).

Stand-by or Backup System: computer built and "standing by" in case of failure of a "live system". This computer may only accept live (commercial) traffic if the "live system" it is intended to replace is not in use.

For clients who have purchased licensing:

Your software license entitles you to install and operate one “live system”. You may also have one “test system” and one “Stand-by or Backup System”. These policies are subject to change at any time with or without notice.

For persons evaluating SoftTouch:

You may install and operate one “test system” under an evaluation license. You do not own a license to operate a “live system” or a “Stand-by or Backup System”.

Additional information:

This installation may include various other executables and files which are provided under this license. These files include our custom rebooting utility (softtouchreboot.exe), backup utility (softtouchbackup.exe), as well as other files.

You may not resell or distribute your copy of SoftTouch or any of the included support files to any other party. Your license is not transferable.

From time to time, we may provide updates or upgrades to our software. In this case, all new versions of our software are covered under this license agreement. In addition, if you downloaded our software .exe separate from this installation, that .exe is subject to these same license conditions.

Our software is provided "as is" with no claims of fitness or merchantability for any particular purpose either expressed or implied. Your use of our software is considered acceptance of these conditions.

Our system prompts (found in the “C:\SoftTouch\Voice” directory) are provided for use with SoftTouch only. The prompts are our copyrighted property and are for evaluating SoftTouch. You may modify the prompts as you see fit, however, you may not distribute the prompts to any other party and may not use the prompts with any other software. In addition, the prompts may not be used wholly or partially for any “live system”.

Use of our software or provided files in any way not permitted in this license is a violation of our copyright and will result in your license being terminated with or without notice.

This software is to be installed and used on only one computer for the purpose of live commercial traffic.  You may install a copy of this software on a "development" machine for the purpose of developing and testing your system.

This installation may include various other executables and files which are provided under this license.  These files include our custom rebooting utility (softtouchreboot.exe), a copy of the scripts used for our prompts (Scripts.doc), as well as other files.

You may not resell your copy of SoftTouch or any of the included support files to any other party.  Your license is not transferable.
